Effective 31 August 2026

Terms built for a useful service.

These terms set the practical ground rules for using Fernboard. They do not remove rights that cannot lawfully be excluded, including Australian Consumer Law rights where they apply.

Beta notice

Fernboard is still being prepared for commercial release. Cloud collaboration may change during the controlled beta, but local-first access and safe export remain core product commitments.

1. Agreement

By accessing or using Fernboard, you agree to these Terms of Use and our Privacy Policy. If you use Fernboard for an organisation, you confirm that you have authority to accept these terms for it.

If you do not agree, do not create an account or use the cloud features. You may still remove data from your own device using your browser or device controls.

2. The service

Fernboard is a local-first visual workspace for notes, tasks, timelines, media and collaboration. Core editing is designed to save on the device first. Optional account features provide authentication, cloud storage and shared workspaces.

Features may be identified as beta, preview or experimental. We may improve, replace or discontinue those features, but will take reasonable steps to avoid silent data loss and to provide export or notice where practical.

3. Accounts and security

You must provide accurate account information, keep credentials secure and promptly tell us about suspected unauthorised use. You are responsible for activity performed through your account unless caused by our failure to use reasonable care.

Do not share an account in a way that defeats workspace permissions. People joining a shared workspace must have authority to view and contribute to its content.

4. Your content and shared workspaces

You retain ownership of content you create or upload. You grant Fernboard a limited, non-exclusive licence to host, copy, transmit, format and process that content only as needed to operate, secure, support and improve the user-facing service.

You control who you invite. Workspace members may view, edit, comment on, export or delete shared content according to their role and the product controls. Keep your own exports of important work and do not upload content you lack permission to use.

5. Acceptable use

You must not use Fernboard to break the law, infringe rights, harass people, distribute malware, probe or bypass security, access another person’s data without permission, overload the service, automate abusive traffic or resell access without written permission.

We may investigate misuse and take proportionate action, including limiting or suspending cloud access where reasonably necessary to protect users, the service or legal compliance.

6. Availability, backups and changes

We aim to provide a reliable service but internet, provider and beta interruptions can occur. Cloud failure should not prevent access to local notes already available on your device. You should export important boards and protect those backup files.

We may perform maintenance and make reasonable product changes. If we plan to end a material cloud feature, we will provide reasonable notice and an export path where practicable, except when urgent security or legal action is required.

7. Third-party services

Fernboard uses providers such as Supabase, Cloudflare, OpenAI Sites and Google. Their systems may be subject to separate terms and availability. Choosing Google sign-in also makes your use of Google’s account service subject to Google’s terms.

8. Fees and consumer rights

Any future paid plan will show its price, billing period, inclusions, renewal and cancellation information before purchase. Additional billing terms presented at checkout will form part of these terms.

Nothing in these terms excludes, restricts or modifies a consumer guarantee, remedy or other right that cannot lawfully be excluded. Where the Australian Consumer Law applies, Fernboard services come with consumer guarantees that cannot be excluded.

9. Our intellectual property

Fernboard’s software, branding, visual design and documentation are owned by us or our licensors. These terms give you a limited, revocable, non-transferable right to use the service for its intended purpose; they do not transfer our intellectual property to you.

10. Suspension and ending use

You may stop using Fernboard at any time. You can export important boards before requesting account deletion. We may suspend or end cloud access for serious or repeated breaches, security risk, legal requirement or non-payment of a future paid plan, using notice and a reasonable opportunity to remedy where appropriate.

Ending cloud access does not authorise us to erase unrelated local data from your device without clear action from you.

11. Responsibility and liability

To the maximum extent permitted by law, neither party is responsible for indirect or consequential loss that was not reasonably foreseeable. Our liability is not limited where doing so would be unlawful, including for applicable consumer guarantees or liability caused by fraud, wilful misconduct or other non-excludable obligations.

12. Contact and changes

These terms are governed by the laws of New South Wales, Australia, and applicable Australian law. Courts with lawful jurisdiction may hear disputes.

We may update these terms as the service develops. We will revise the effective date and give reasonable notice of material changes. Questions can be sent to betternote.management@gmail.com.
